Interactive wagering requires players to be at least 21. An operator may accept wagers from a patron physically within West Virginia through the patron’s interactive wagering account using a Commission-approved mobile or other digital platform or interactive wagering device. Wagers from a patron in another jurisdiction require an interactive wagering agreement, an approved device or platform and satisfaction of all other agreement requirements.

Rule 179-10, effective 27 April 2026, expressly defines peer-to-peer gaming to include poker and regulates server-based peer-to-peer games.
