Brazil betting shutdown: the SPA register after MP 1.394/2026

MP 1.394/2026 prohibits the operation, offer, intermediation and advertising of fixed-odds betting in Brazil. Its scope includes real sporting events and virtual online games, including services offered from abroad to people in Brazil. Other legally authorised lottery modalities are outside this particular prohibition.

Article 30 makes the measure effective on publication. The Planalto text and official index identify the 25 September 2026 extra edition of the Diário Oficial da União. On 25 October the official index still listed the measure as pending in Congress. The detailed Congress page was not substantively recovered in this review, so no new claim about committee proceedings, votes or later amendments is made.

From publication, the measure bars new authorisations and incoming funds into bettor transaction accounts, subject to its narrow exception for realising previously invested bettor assets to meet repayment obligations. Article 7 requires betting sites and apps to become inaccessible ten days after publication. Article 4 provides for authorisations to end after thirty days.

The Ministry of Justice notice, updated 29 September and reread 25 October, sets voluntary withdrawals of remaining balances through 5 October 2026 at 23:59 and website/app unavailability from 6 October. The Senate timetable identifies 25 October as the statutory deadline for authorisations to end. Reaching that calendar date does not prove the precise expiry instant, implementation for every operator or completed restitution. Case-specific exceptions require their own current authoritative evidence.

The measure sets separate duties for unsettled bets, prizes, balances and repayments. A remaining authorisation entry is not evidence that new deposits or normal marketing remain permitted. Atlas therefore holds commercial presentation during the transition and does not prematurely describe every individual authorisation as already revoked.

Article 16 prohibits fixed-odds advertising, marketing and sponsorship and gives ten days to remove existing materials. Article 17 preserves a limited exception for older content carrying incidental advertising. The July 2026 risk-warning rules are historical context; compliance with those warnings does not establish permission to advertise under the new measure.

On 25 October Atlas reread the complete SPA administrative and separate judicial pages. The administrative page is marked updated 9 October and expressly describes authorisations before MP 1.394/2026. Its rows identify legal entities, CNPJs, brands, domains, ordinances, SIGAP requests and process-document links. Continued publication of that historical table does not certify unrestricted current operation.

That reconciliation establishes what the source table contains. It does not establish that every listed operation may continue without restriction after 25 September. The register record, current law and any later case-specific decision answer different questions.

The reconciled administrative table has 85 authorisation rows and 82 unique CNPJs because an entity may appear in more than one authorisation row. It contains 188 brand rows, 185 defined domains and three domains still marked to be defined. These counts are retained as pre-measure register metrics.

The structured extract retains its 24 August snapshot and the separately documented 26 September reconciliation, including the earlier LOGAME request correction to 0095/2024. The 25 October review recounted the full administrative table and checked nine selected profile associations; it does not renew every raw record, legal-entity field or domain verification date.

SPA publishes court-order operations separately from administrative authorisations. The judicial page, marked updated 1 October and read 25 October, retains 2 companies and 6 brand-domain rows; its download labels still carry 4 February 2026. These historical entries do not themselves establish an individual exception to the later MP.

The listed proceedings establish the basis SPA recorded for those rows. They do not establish a later exception to MP 1.394/2026. A specific current decision would need to be read before claiming that an operation is exempt from the new restrictions.

The SPA overview describes the framework that began national authorised operation on 1 January 2025. It allowed up to three brands per authorisation, with consumer websites in the .bet.br namespace. Fixed-odds sports betting and covered online games had separate statutory origins under Laws 13,756/2018 and 14,790/2023.

For historical verification, match the legal entity and CNPJ to the brand, exact domain, ordinance and amendments. A familiar international brand or .bet.br ending alone is insufficient. The company table does not supply a product-by-product permission list, and the preceding framework must now be read alongside the shutdown measure.

From 12 August 2026, SPA began publishing administrative material behind 85 authorisations. Its announcement reported 582 treated documents across 2,240 pages after personal or restricted information was removed or anonymised. These figures retain their 24 August source-check scope.

The release covered legal qualification, suitability, origin of funds, financial capacity, fee payment and final analysis. Those documents can explain the grounds for previous authorisations. This update does not recheck every underlying process document or convert that history into current operational permission.

Start with the current legal position, then identify the exact register record. Keep each finding tied to its own source and date.

The SIGAP application service records requests, not completed authorisations. An application did not establish operating permission under the preceding framework and does not establish permission during this transition.

If an exact brand or domain does not match the recorded company, test legal names and spelling variants and describe the source gap precisely. A missing match alone does not prove an individual revocation, and a successful historical match does not override the new measure.

The material policy change requires prompt review after any official amendment, court decision, parliamentary action or SPA implementation notice. The ordinary 30-day cadence is not a reason to postpone a known change.

The 25 October update rechecks the complete MP, current Planalto index, government and Senate timetable, and historical SPA table pages. The detailed Congress record was not recovered. August process-library figures, the structured extract and its individual source/identity clocks remain unchanged. This update records a statutory deadline and source review, not completed extinction, refunds, a tribunal disposition or a new licence exception.
