Procedural status

Federal tax interpretation published

Cosit 157 records the Receita Federal's interpretation of the personal income-tax calculation. The operative law, annual exemption threshold, service instructions and tax-year calculator still have to be read together.

The calculation is annual, not withdrawal by withdrawal

Brazil's Receita Federal has published an interpretation of how individuals calculate tax on fixed-odds betting and fantasy-sport prizes. Cosit 157 says the taxpayer looks at the previous calendar year's results across all betting operators. That is different from treating each withdrawal, winning ticket or positive month as a self-contained taxable prize.

The practical starting point is the ComprovaBet record supplied by each operator. The federal service says this document consolidates a person's results across all brands run by that operator. A bettor with accounts at several operators therefore needs all of those records before the annual position can be calculated.

Three categories are calculated separately

Cosit 157 divides the calculation into bets on real sporting events, virtual online games and fantasy sport. Gains and losses are combined within each category first. The positive category results are then added to produce the net prize used for the tax calculation.

That order matters. The ruling does not describe one unrestricted pot in which every gambling loss cancels every gain. If one category finishes negative and another positive, the negative category is not presented as an offset against the positive one. It also means that a promotional account balance or a single operator's dashboard is not enough to reproduce the federal method.

The 15% headline has an exemption threshold

Article 31 of Law 14,790 states a 15% IRPF rate for net prizes from fixed-odds betting. The federal service page adds an important qualification: the rate applies only to the part of the annual net prize that exceeds the annual income-tax exemption threshold.

Cosit 157 does not publish a universal tax bill for bettors. The result depends on the records, the category calculation and the threshold for the relevant year. Anyone applying the rule to a personal return should use the Receita's tax-year instructions or obtain qualified tax advice rather than copy a worked example from another year.

The bettor, not the operator, completes the final calculation

Operators supply the evidence, but the Receita places the final calculation on the taxpayer. The government service says ComprovaBet should be available by the last business day of February. The taxpayer then enters the results into the Receita application in March.

If the application shows tax due, the person issues a Darf and pays by the last business day of April. The operator's role in producing ComprovaBet should not be confused with withholding or settling the final liability on the customer's behalf.

The live calculator is tied to calendar year 2025

The current Receita application explicitly says it calculates IRPF on fixed-odds betting and fantasy-sport results obtained during calendar year 2025. It accepts information by commercial brand or consolidated by operator, using the values in ComprovaBet.

That year label is a real limit. The workflow provides the best current model, but readers should not assume that the same threshold, dates or fields will carry forward unchanged. The next annual calculator and service update will be the controlling operational evidence for later results.

What the ruling does not cover

The documents reviewed here concern individuals using the Brazilian fixed-odds betting and fantasy-sport framework. They do not settle the treatment of offshore gambling, corporate activity, professional status, foreign income or every type of promotional credit. Those questions may engage different rules.

The ruling also does not decide whether a betting website is authorised. That requires a separate check of the operator, brand and exact domain in the SPA records. Tax treatment and regulatory authorisation answer different questions, even when the same transaction appears in both contexts.

Atlas view: good records now matter more than a memorable percentage

The 15% rate is easy to repeat, but it is not the part most likely to cause an incorrect calculation. The harder work is collecting every operator statement, keeping the three categories separate and using the correct tax-year threshold and application.

That points to a useful compliance test for the regulated market. Operators should make ComprovaBet easy to find, identify the legal operator behind each brand and explain which values feed each category. The Receita's next service update should then be checked against those records before anyone treats the 2026 ruling as a permanent template.
