Ten selected files, ten regulatory findings

The Kansspelautoriteit fined online operator 711 B.V. €886,000 after reviewing ten customer files and finding duty-of-care breaches in every one. The files concerned people with high losses, frequent gambling days and night-time activity - the sort of behaviour that should bring a licensee's monitoring and intervention systems into focus.

The all-ten result is strong, but the sample needs careful description. These were risk-selected files, not ten customers drawn at random from the operator's entire database. The finding supports a serious conclusion about how 711 handled the examined high-risk cases, not a claim that every customer account contained a breach.

What the regulator says went wrong

According to the Ksa, 711 did not analyse user gambling behaviour well enough and did not take the right measures to intervene. That left play capable of escalating and, in some cases, exposed customers to substantial losses. The regulator examined conduct from February 2022 through June 2024.

The notice does not give a single universal failure repeated identically ten times. Duty-of-care reviews can involve the timing of detection, the quality of analysis, customer contact, restrictions and follow-up. The public conclusion is that violations appeared in all selected files and that both analysis and intervention were inadequate.

Why the historic period still matters

The investigated period began only months after the regulated Dutch online market opened. Ksa chair Michel Groothuizen said the authority had seen operators implement the duty of care unevenly from the market's launch and had carried out additional investigations that were now producing penalties.

That context does not lower the standard that applied at the time. It explains the regulator's wider enforcement programme and why several duty-of-care decisions have appeared after lengthy reviews. The June 2026 announcement concerns historic customer files, while the sanction and its legal status are current.

The €886,000 decision can still be challenged

The substantive sanction was signed on 26 May and sent on 29 May. The 28 May date used in the earlier article belongs to the separate publication decision, not the fine itself. That distinction has now been corrected.

The formal decision also records 711’s written and oral response. The company challenged the legal basis, proportionality, risk-model analysis and likely damage from publication. The Ksa rejected those arguments when imposing the sanction.

The six-week objection period has passed, but the current Ksa page does not disclose whether an objection was filed. The accurate position is therefore narrower than either “appeal still open” or “finally unappealable”: the fine exists, and the next procedural filing is not public.

This does not change the regulator’s substantive finding across all ten files. It changes only the procedural label and the right-of-reply record, both of which determine how confidently the article can describe finality and the company’s position. A later filing must be attached to the exact administrative or judicial stage it addresses.

The private customer details stay private

The regulator does not identify the ten customers or publish a table of their losses, ages, incomes or contacts with 711. That protects the individuals and limits what can be reported. High losses and night play are selection characteristics in the Ksa's summary, not permission to invent personal stories around unnamed people.

The next record to watch is procedural: an objection by 711, a decision on that objection or a further court step. Until then, the central facts remain the €886,000 sanction, the February 2022 to June 2024 review period and violations found across all ten selected high-risk files.
